1. Product Delivery & Access

All digital products are delivered via email following successful payment. Coaching services, courses, and membership access are delivered via the relevant platform and login credentials provided after purchase.

Delivery of digital products is typically within 5 minutes but may take slightly longer during peak periods or depending on your email provider.

You are responsible for providing a valid and correctly spelled email address at checkout. You must check your inbox, junk, and promotions folders thoroughly before contacting support.

2. Results Disclaimer

All digital products, templates, coaching services, and memberships sold through BeWell Design are for educational and informational purposes only.

No results or income levels are guaranteed. Your success depends on your individual effort, market, execution, and circumstances.

Our content and services do not replace professional legal, financial, or business advice.

3. Final Sale Policy

Due to the instant-access nature of our digital products, all sales are final and non-refundable.

We do not offer refunds, exchanges, or cancellations for any reason once access has been granted.

4. Coaching Services

All coaching purchases are final and non-refundable from the point of purchase. Once you complete payment, the coaching agreement is in effect and your slot is reserved. This includes any sessions that have not yet been taken. By purchasing a coaching service, you are reserving a slot that could otherwise have been allocated to another client. No credits or transfers to another person will be issued under any circumstances.

If you need to reschedule a session, you must provide a minimum of 48 hours' notice. If less than 48 hours' notice is given, your session will be forfeit and you will not receive a replacement session.

5. Memberships

All annual membership purchases are final and non-refundable.

Monthly memberships may be cancelled at any time by the member. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the period you have already paid for.

It is your responsibility to cancel your own membership if you no longer wish to be billed. We do not offer refunds for any billing periods that have already been charged, including months where you did not actively use the membership.

Cancellation must be completed by the member directly through the membership platform. BeWell Design is not responsible for cancelling memberships on your behalf.

6. Discounts, Promotions & Coupon Codes

Prices of products and services may be discounted or promoted from time to time at our sole discretion.

If you purchase a product at full price and it is later offered at a reduced price, this does not entitle you to a refund, partial refund, credit, or price adjustment of any kind.

Coupon and discount codes must be entered at checkout before completing your purchase. It is your sole responsibility to apply any discount codes before payment is processed.

Coupon codes cannot be applied retroactively after a purchase has been completed. BeWell Design is not obligated to honour missed, expired, or incorrectly entered codes.

7. Pricing & Currency

Prices for digital products and services may be listed either USD ($) or GBP (£) depending on the platform, product, or promotion.

It is your responsibility to check the listed currency before completing a purchase. Currency conversion and international transaction fees (if applicable) are the responsibility of the customer.

Prices are subject to change at any time without prior notice.

8. Resell & Usage Rights

Unless explicitly stated, all digital products are sold for personal use only. You may not:

• Resell

• Reproduce

• Distribute

• License

• Share

• Modify or claim ownership

Only products that clearly state PLR (Private Label Rights) or resell rights include those permissions. Products marked with PLR or Resell Rights:

• May only be resold for personal use by your end customer.

• You may not resell these products with PLR or resell rights attached.

• In short: you cannot sell the rights to resell.

9. Intellectual Property & Copyright

All content, templates, digital downloads, and materials sold or given away (free or paid) through BeWell Design remain the intellectual property of Rochelle Bramwell / BeWell Design.

You may not:

• Copy or duplicate any part of the content

• File for copyright or trademarks on any of our materials

• Use our content for misleading, unlawful, or competitive purposes

Legal action will be taken against any individual or business found to be unlawfully reproducing, repackaging, reselling, or misusing our intellectual property.

10. Testimonials

Any testimonials shared on our platforms reflect the experiences of individual users and may not be typical.

They are not guarantees or promises of your success or outcome.

11. Account Security & Termination

If your purchase includes access to an account, course, or membership:

• You are responsible for maintaining the confidentiality of your login credentials.

• Sharing your login credentials with others or giving another person access to your account is a violation of these Terms.

• BeWell Design reserves the right to suspend or terminate your access without notice and without refund if these Terms are violated.

12. Limitation of Liability

To the fullest extent permitted by law, BeWell Design's total liability arising from or related to any product, service, or content is limited to the amount you paid for the specific product or service giving rise to the claim.

BeWell Design shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of revenue, loss of profits, or loss of business opportunities, whether or not we were advised of the possibility of such damages.

13. Service Interruptions

We make reasonable efforts to ensure our platforms, courses, and services are available and functioning. However, we are not liable for temporary interruptions, delays, or inability to deliver services due to circumstances beyond our reasonable control, including but not limited to illness, technical failures, platform outages, or force majeure events.

Where coaching or membership services are affected, we will make reasonable efforts to reschedule or restore access as soon as practicable.

14. Eligibility & Capacity

By purchasing or accessing our content, you confirm that:

• You are at least 18 years old and have the legal capacity to enter into a binding agreement.

• If purchasing on behalf of an entity, you are authorised to bind that entity.

15. Third-Party Tools & Resources

Some of our products may link to or reference third-party tools, platforms, or resources (e.g., Canva, email software, Skool).

We are not responsible for the content, performance, pricing, or policies of these third-party services.

16. Support & Contact

Your use of our website and services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

18. Changes to Terms

Continued use of our site or products after changes have been communicated constitutes your acceptance of the revised Terms.

19. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Kingdom.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
